Whether participants' personal consumption counts as a sale to an "ultimate user" is the central legal question in most pyramid scheme cases. The FTC's position, expressed in guidance and settlements, is that personal purchases can count only where they reflect genuine demand at a reasonable price and are not driven by qualification requirements.
